1. Acceptance of Terms
By accessing or using the Propertify – Real Estate Bay mobile application and related services (“Platform”), you agree to be legally bound by these Terms & Conditions, our Privacy Policy, and all applicable laws of India, including the Information Technology Act, 2000. If you do not agree, please do not use the Platform.
2. Definitions
– “Platform” refers to Propertify mobile application and Avontra.in website
– “User” refers to anyone accessing the Platform
– “Free User” refers to users using basic services without payment
– “Premium User” refers to users subscribed to paid services
– “Lister/Agent” refers to users posting property listings
– “Buyer/Tenant” refers to users browsing or inquiring about listings
– “Lead” refers to contact information shared between users
3. Platform Nature – Lead Generation Service
3.1. The Platform operates as a lead generation service only
3.2. We facilitate connections between property listers/agents and potential buyers/tenants
3.3. We are not responsible for:
– Transactions between users after lead sharing
– Misuse of contact information once shared
– Verification of user identities or property details
– Any disputes arising from user interactions
4. Service Tiers
4.1. Free Services
– Basic property listing creation
– Limited lead generation (1 leads per month)
– Standard profile visibility
– Basic search functionality
– Standard customer support
4.2. Premium Services
4.2.1. Premium Listing Features:
– Priority listing in search results
– Featured property badges
– Enhanced visibility on homepage
– Unlimited lead generation
– Premium customer support
4.2.2. Premium Subscription Plans:
Subscription plans, pricing, features, and benefits may be modified, updated, or discontinued from time to time based on market conditions, competitive factors, regulatory requirements, or business needs. Any changes to subscription pricing or features will not adversely affect active paid subscriptions until the end of the current billing cycle, unless such changes are required by applicable law.

Subscription benefits are provided on a best-effort basis and do not guarantee property sales, rentals, lead conversion, revenue generation, or business success. Actual outcomes may vary depending on market conditions, property demand, pricing, location, and user interactions.
5. Payments and Billing
5.1. Subscription Fees:
– All prices in Indian Rupees (₹)
– GST @ 18% applicable on all purchases
– Cancel anytime, no prorated refunds
5.2. Payment Methods:
– Credit/Debit Cards (Indian and International)
– UPI Payments
– Net Banking
– Digital Wallets (PayTM, PhonePe, etc.)
5.3. Billing Cycle:
– Monthly/Quarterly/Annual plans available
– Renewal date based on original purchase
5.4. Refund Policy:
– No refunds for used subscription periods
– Technical issues resolved within 7 days
– Disputed charges investigated case-by-case
6. User Accounts & Verification
6.1. You must be at least 18 years old and competent to contract under Indian Contract Act, 1872
6.2. Basic mobile number verification may be conducted
6.3. Premium users may require additional verification
6.4. Users are solely responsible for maintaining account security
7. Listing Guidelines for Indian Market
7.1. Prohibited Content:
– False, misleading property information
– Properties without proper ownership/authority to list
– Content violating Indian laws (Hindu Succession Act, Transfer of Property Act, etc.)
– Discriminatory content based on caste, religion, gender, etc.
– Multiple fake or duplicate listings

-Compliance with RERA (where applicable)
We reserve the right to remove listings without notice if violations are found.
7.2. Required Disclosures:
– Accurate property details (carpet area, amenities, etc.)
– Clear title status and ownership details
– RERA registration number (if applicable)
– Accurate location and contact information
8. Lead Generation & Sharing Mechanism
8.1. Free User Leads:
– Basic contact information shared
– Limited lead quality assurance
– Standard response time
8.2. Premium User Benefits:
– Premium Lead Priority: Premium users receive leads first
– Enhanced Lead Details: Additional user preferences and behaviour insights
– Lead Quality Scores: Rated leads based on user engagement
– Direct Contact Access: Immediate phone number access
– Lead Management Tools: CRM integration and tracking
8.3. By submitting inquiries, users expressly consent to:
– Sharing their contact details with listing agents
– Receiving communications from multiple agents
– Being contacted via call, SMS, WhatsApp, email
8.4. Once contact information is shared:
– Platform responsibility ends
– Users deal directly with each other
– Platform not liable for any misuse of information
9. Premium Features Specific Terms
9.1. Featured Listings:
– Premium listings highlighted across platform
– Rotating featured spots on homepage
– Extended visibility duration
9.2. Analytics and Reporting:
– Data provided “as is” without guarantees
– Historical performance trends
– Lead conversion metrics
– Market comparison data
9.3. Account Management:
– Dedicated support for enterprise users
– Customized training sessions
– API access (enterprise plan only)
10. User Responsibilities & Liabilities
10.1. Listers/Agents are responsible for:
– Verifying buyer/tenant credentials
– Conducting due diligence on documents
– Complying with RERA regulations (if applicable)
10.2. Buyers/Tenants are responsible for:
– Verifying property details and ownership
– Conducting site visits and legal checks
– Negotiating terms and documentation
11. Subscription Management
11.1. Cancellation Policy:
– Cancel anytime from account settings
– Service continues until end of billing period
– No refunds for partial months
11.3. Service Interruption:
– 3-day grace period for failed payments
– Account downgrade to free tier after suspension
– Data preserved for 30 days post-cancellation
12. Intellectual Property
12.1. Platform content owned by Avontra.in
12.2. Users grant license to display their content
12.3. Compliance with Indian Copyright Act, 1957
12.4. Premium features and analytics are proprietary
All Platform content, trademarks, designs, and software are owned by the Platform owner. Users grant us a non-exclusive license to display their submitted content.
13. Limitation of Liability – Critical Disclaimer
13.1. No Responsibility for User Interactions:
The Platform only facilitates initial connections. We are not liable for:
– Fraudulent transactions between users
– Misrepresentation of properties
– Financial losses or legal disputes
– Personal safety issues during site visits

- Use of the Platform is at your own risk
- We do not guarantee uninterrupted service
13.2. Lead Quality Disclaimer:
We do not guarantee:
– Genuineness of user intentions
– Response rates from agents
– Conversion of leads to transactions

13.3. Service Availability:
– No guarantee of 100% uptime
– Scheduled maintenance announcements

14. Indemnification (VERY IMPORTANT)
Users agree to indemnify and hold harmless the Platform, its owners, and affiliates from any claims, losses, damages, or legal actions arising from:

17. Amendments
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of revised terms.
18. Governing Law & Jurisdiction
